Please read these Terms and Conditions carefully to confirm that you have understood and agree to them.

By accepting these Terms and Conditions, you enter into a service contract between BERDAC SMART SERVICES, S.L. (hereinafter "BERDAC" or "us") and yourself (hereinafter the "User").

Description of the Service

BERDAC provides an advisory service to improve the User's medical treatment follow-up.

Additionally, if the User so wishes, we can act as their representative to key parties involved in improving medical treatment adherence, such as a caregiver, nurse, doctor or pharmacist.

Disclaimer

BERDAC is committed to full transparency and compliance with the law. By accepting these Terms and Conditions, you acknowledge that BERDAC will NEVER provide the following services:

  • Pharmacy selection: BERDAC is not a pharmacy and does not provide pharmacy selection services.
  • Medication purchase: BERDAC is not a pharmacy and this website is not an e-commerce store.
  • Intermediation in medication purchases: BERDAC will NEVER act as an intermediary in the purchase of medication.
  • In any case: You acknowledge that your relationship with a pharmacy is direct and without intermediaries.

Billing and payment

You acknowledge and agree that the subscription to this Service has a monthly cost as listed on the main page (excluding taxes).

Cancellation

You may cancel the Service at any time by sending an email to support@ima.health.

Grounds for denial or suspension of Service

BERDAC reserves the right to deny or cancel the Service immediately in the following cases: insufficient or incorrect personal data, disrespect toward BERDAC staff, fraudulent or abusive use, non-payment, or other technical, organizational, or administrative reasons.

Duration

These Terms and Conditions are of indefinite duration. Any modifications will be published by updating the relevant documentation on the website.

Customer support

BERDAC provides telephone customer support Monday to Friday, from 9:00 a.m. to 6:00 p.m.

Personal data protection and data sharing

Your personal data provided to BERDAC will be used to provide the Service. You understand and agree that such data may be shared with third parties in order to deliver quality assistance.

You may exercise your rights of access, rectification, objection, erasure, portability and restriction by contacting lopd@ima.health.

Dispute resolution

With express waiver of any other jurisdiction, any dispute arising from the interpretation or performance of this document shall be submitted to the Courts of Barcelona.
